USE THIS RIGHT! DO NOT GIVE EXTRA INFORMATION WHICH CAN BE PUT AGAINST YOU! It is wise to refrain from replying any question or telling things that doesn’t relate to your personal identity like name, date of birth, address or your car registration, car insurance, and driving license because this is the only information which law demands from you to give to detaining police officers or to authorities involved in your arrest, chemical examination, or imprisonment.
Yes, California laws DO demand from you to provide identification, verify your present address, and show the documents like your vehicle registration, car insurance, and license…but not anything beyond IT!
Use your right to keep silent because anything you state except what has been asked by law can inevitably be taken against you as evidence if you’re charged with DUI. The little you speak, the better it is.
Remain polite and courteous, and tell the police officer that you have decided to not reply any questions other than demanded by law.
You’re NOT demanded to reveal where you’ve been, where you’re moving, or what you’ve been doing OR whether you drunken any alcoholic beverage or drugs. Moreover, you are also not required to disclose your business, your living habits, why you’re driving, what you’ve eaten, or any other interrogation not concerning to your name, address, vehicle registration, proof of insurance, or driving license.
If you’ve said you don’t want to give more information than is needed by law, and interrogating keeps on going, you could prefer to answer by asking “am I free to go now?” If you’re still being interrogated more, you could say “Do you need to check my driving license again?”, or “would you require to check my vehicle registration again?” etc.
Do not make an error of speaking your way out of an arrest. It will not make, but you will hate yourself afterwards.
You should realize that the cops are not your buddies, irrespective of how sympathizing or kind they may look, REMAIN SILENT! You do not require lying, and you do not require to not lying. Do not state anything as it is your right.
Be cooperative and courteous, and remain firmly reserved. Do not put yourself over into guessing that if you just “excuse” you just had “two” topes, the police officer will give you a time out since you seems to be “honest” and a “nice guy”. They checked you for a suspicion, and if they even find you might have had a drink, they will definitely take you to jail…that’s their duty.
