On Saturday night when Arlington police arrived at the crash involving Alexandria Police Chief David P. Baker, a strong odor of alcohol has been smelled by an officer and he also noticed that Baker’s speech was repetitive and hesitant, according to a criminal complaint.

Baker, who is on administrative leave, has failed four field sobriety tests: namely the nine-step walk and turn, the 30-second leg lift, counting backwards and saying the alphabet, as said by the complaint.

About two hours after the accident, just after midnight, Baker took a breath test, by which a blood alcohol level of 0.19 was registered, which is more than twice of the legal limit of 0.08.

The report said that Baker, who is 6-foot-1 and weighs 210 pounds, has told police that he had two beers about 20 minutes before that the accident took place. When it was asked by the arresting officer that where Baker had been earlier that night, Baker had not given a clear answer.

Baker, 58, was charged with DUI, which is a misdemeanor that’s punishment is up to 12 months imprisonment in jail and a fine of as much as $2,500. According to Virginia law, if a person is convicted of driving with a blood alcohol level of more than 0.15, then it is required that he must spend a minimum of five days in jail. It is mentioned by his arrest warrant that this was his first offense. He is due in court Wednesday.

An internal investigation has been ordered by Hartmann who is city manager, which will be conducted by Alexandria’s human resources department and the city attorney’s office. It has been said by him that he expects that the investigation would be completed by the end of the week and then he will probably decide that whether Baker will keep his job.
