« What is the DUI Exception to the Constitution?

For years we had hear about the “slaughter on the nation’s highways”, we have also read tragic stories of people dying as a result of fatal hit by drunk drivers.

Pressure groups such as MADD have gained wild success in fomenting public hysteria and, and no politician could ever had such courage to oppose them, they have been pushing through ever stricter DUI laws and most harsh punishments. As a result of all these things, we are given a repeated assurance that the number of “alcohol related” traffic fatalities have continued to decrease dramatically.

I am a lawyer. I use to defend those that are accused of driving under the influence. I have seen the other side of the story every day.

 

I have seen many politicians that stumble over themselves in order to prove that who is the toughest on drunk driving. I have seen the judges watching members of MADD in the audience nervously as they pass sentence in a DUI case. I can see the the gradual erosion of our Constitutional rights in DUI cases, it is that phenomenon that has came to be known as “the DUI exception to the Constitution”: there are illegal DUI sobriety checkpoints, cops conducts forceful and violent seizure of blood, convicted person are not given any right to see a lawyer, double jeopardy, refusal of the right to a jury trial, assuming a person as guilty, defective breath tests are accepted blindly into evidence, scientific facts that are banned by law from the courtroom, routine violations of dui process and basic fairness in trial…. all these things have no other reason than that “the ends justify the means”.

 

But for all these perversion of the American system of justice there is a cost and that is there are unseen victims: you and I. I would really like to talk to you about that. And your comments are welcomed here.
