« Kane Co. prosecutor considers ending DUI stings
Kane County State’s Attorney John Barsanti has said that due to lack of cooperation from police he might abandon an aggressive DUI campaign.
On Tuesday, Barsanti said that recently two municipal police departments have turned him down, who have previously expressed interest in conducting "No Refusal" crackdowns in their jurisdictions. The objection that has been raised by the agencies, which Barsanti would not name, was that they thought it was a controversial subject.

It has been said by Barsanti that it’s a kind of surprising to him. He thought that they would have more support from the law enforcement communities.
"No Refusal" is the name given to a program where on-the-spot search warrants are obtained by police and prosecutors in order to draw blood or give breath tests to motorists suspected of driving drunk. Those drivers who will refuse can face additional charges, such as contempt of court.
Locally, the program has been introduced Memorial Day 2008 in unincorporated Kane County, and it has continued on subsequent holidays in the Tri-Cities and Elgin, and at that time this program has yield more than 20 arrests.
It has said by Barsanti that the departments that have decided to not to participate “were not all that clear” about why, but it has been speculated by him that by some members of the public this operation might have been viewed as "an abuse of power," even though it is within the law.
Barsanti said that one misperception might be that drivers are randomly pulled over by the officers and "stick a needle in their arms." Instead of doing that, police must first have a reason to conduct a traffic stop, then they must also have a probable cause to request a voluntary DUI test.
