- A news channel in Chicago recently showed footage of a surveillance video of a police officer accused of making fake DUI arrests.
There were a series of complaints against Officer Richard Fiorito, which lead his superiors to order him to use a video camera in his squad car. The footage from this camera has now caused the officer to be caused of making fake arrests. The video is now being used against Fiorito in a law suit involving 21 people who are accusing the officer of having a DUI scheme.
In the footage, Fiorito can be seen pursuing the arrest of a suspected DUI suspect aggressively. He had been called to the scene because of his specific experience in DUI arrests. The video also shows the field sobriety tests that were taken, and many attorneys feel that the suspect passed the tests and despite the good performance on them, they were charged with dui by the officer.
A federal civil law suit has been filed against the officer in which 21 people who have been accused have given their testimony against him. The plaintiffs all say they were targeted for leaving bars or driving late at night. According to all of them, Fiorito routinely lied in court in order to get them convicted of DUI so he could raise his personal DUI arrest numbers. In fact, Fiorito has been awarded by MADD for his accomplishments in this area – around 300 arrests a year.
Moreover, whenever Fiorito testifies in court, he gets paid time-and-a-half. There are some attorneys who feel the DUI arrests are a deliberate attempt to get that payment. Fiorito is under investigation from Cook County state’s attorney’s office in connection to the various DUI arrests and subsequent civil law suit.
Although the case has been filed and is pending, Fiorito is still an active officer. In case he is found to be guilty, he may receive a suspension. But for now, he is still practicing his specialty of making DUI arrests.
