Blood Alcohol Concentration (BAC)
In Colorado a driver with blood alcohol concentration above than 0.08 percent will be considered “per se intoxicated” according to law. That is the only condition, which is enough to verify a driver to be convicted for Driving Under the Influence (DUI) or Driving While Intoxicated (DWI).
Zero Tolerance Blood Alcohol Concentration
In all states zero tolerance laws mainly focus on the drivers who are not of legal drinking age. In Colorado, persons under 21 years of age operating motor vehicle with blood alcohol level .02% or above will be subject to DUI penalties.
Enhanced Penalty Blood Alcohol Concentration
Some states are having more severe punishment for those convicted of DUI with a high blood alcohol level at the time of arrest; the legal limit for that is .15 or .20 percent or above than that. In Colorado, enhanced penalty laws are not utilized.
Administrative License Suspension/Revocation Penalties
These are minimum mandatory penalties implied for drivers who are having blood alcohol level .08% or above and those drivers will be subject to the implied consent laws for declining to submit to breath, blood, or urine testing for blood alcohol content.
These penalties include suspension or revocation of the driver’s license by the DMV (Department of Motor Vehicles). In Colorado, offender with 1st DUI offense will get penalty of 90 days mandatory license suspension; for second offense it will be one year and for third offense the suspension will be up to three years.
Vehicle Confiscation
Vehicle confiscation fine is an option in some states usually for repeat offenders. While is this not a penalty in Colorado.
Ignition Interlock
Ignition interlock is a device that is attached with the convicted DUI offender’s vehicle so that the driver will complete the breath test before starting the vehicle. This penalty is an option in some states while in Colorado it is not an option.
Mandatory Alcohol Education and Assessment/Treatment
Alcohol education and prevention program, treatment for alcohol abuse, and judgment of a person for possible alcohol or drug dependency will possibly be required for DUI offenders in Colorado. Often these steps are suggested instead of harsh punishment of imprisonment or paying fines.
