DUI drivers are required to concede breath, blood, or urine test for blood alcohol content if caught by police is called “implied consent laws”. Refusal carries penalties, which includes mandatory suspension of a driving license for up to a year.

Blood Alcohol Concentration (BAC)
If any driver in Maine will be having blood alcohol concentration above than 0.08 percent then he/she will measured as “per se intoxicated” under this law. According to this law that is all which is needed for a driver to be convicted for Driving Under the Influence (DUI) or Driving While Intoxicated (DWI).
Zero Tolerance Blood Alcohol Concentration
All states “zero tolerance laws” mainly focus on the drivers not of legal drinking age. Drivers under the age of 21 if will be operating any motor vehicle with blood alcohol level 0.02 percent or above will be subject to DUI penalties in Maine.
Enhanced Penalty Blood Alcohol Concentration
Some states are having harsh punishments for DUI offenders with high blood alcohol level at the time of arrest, usually that is 0.15 to 0.20 percent above the legal limit. In Maine, enhanced DUI penalties are not utilized.
Administrative License Suspension/Revocation Penalties
There are minimum obligatory penalties for suspected DUI drivers with blood alcohol concentration above than 0.08 percent or they will be subject to the implied consent laws if they refuse to go under breath, blood, or urine test for blood alcohol content.
Such penalties include suspension or revocation (permanently or temporarily) of a driver’s license by DMV. For first DUI offense in Maine the mandatory suspension is for 90 days; for second offense it is for one year; and for third offense its for up to three years.
Vehicle Confiscation
Vehicle confiscation fine for DUI conviction temporarily or permanently is a chance in some states specifically for repeat offenders. While in Maine this is not an option.
Ignition Interlock
Ignition interlock is a device, that is attached with the vehicle of DUI offender so that he/she will submit to breath test before starting the vehicle. This DUI penalty is an option in some states but in Maine this is not a choice.
Mandatory Alcohol Education and Assessment/Treatment
Alcohol teaching and prevention program, treatment for alcohol abuse and assessment of a person for possible drug or alcohol dependency can be required for DUI offenders in Maine. These steps are often taken instead of serving harsh punishments like imprisonment or paying heavy fines.
