Law require a suspected DUI drivers to concede to breath, blood, or urine testing for alcohol level are know as “implied consent laws”. Refusal carries penalties including mandatory suspension of a driving license for up to a year.

Blood Alcohol Concentration (BAC)
Any driver with blood alcohol concentration (BAC) above 0.08 percent in Iowa will be considered “per se intoxicated” under the law. Under this rule of law, this proof is sufficient for a driver to be convicted of Driving Under the Influence (DUI) or Driving While Intoxicated (DWI).
Zero Tolerance Blood Alcohol Concentration
Almost all states “zero tolerance” law’s main focus is on the drivers not of legal drinking age. In Iowa, if any driver under the age of 21 will be driving the motor vehicle with blood alcohol concentration of 0.02 percent or above will be subject to DUI penalties.
Enhanced Penalty Blood Alcohol Concentration
Some states are having more severe sentence for DUI conviction with high blood alcohol level at the time of arrest; that blood alcohol level is usually .15 to .20 percent above the legal limit. In Iowa, these laws are not utilized.
Administrative License Suspension/Revocation Penalties
Administrative license suspension or revocation penalties are the minimum mandatory penalties enforced on drivers who will be having blood alcohol concentration above the Iowa’s maximum legal limit of 0.08 percent or they will be subject to implied consent laws for refusing to submit to breath, blood, or urine testing for blood alcohol concentration (BAC).
These penalties includes suspension of revocation (means temporarily or permanently removal) of the driver’s license by the Department of Motor Vehicles (DMV). For DUI conviction in Iowa the license suspension is for 90 days; for second its for one year; and for third offense its three years.
Vehicle Confiscation
Vehicle confiscation for DUI conviction temporarily or permanently is an opportunity in some states usually for repeat offenders. While in Iowa this is not an option.
Ignition Interlock
Ignition interlock is a device which is attached with the DUI offender’s vehicle so that he submit to breath test before starting the vehicle. This penalty can be possible in some states while in Iowa this is not an option.
Compulsory Alcohol Education and Assessment/Treatment
Alcohol teaching and prevention program, alcohol abuse treatment, and assessment of a person for possible alcohol or drug reliance can be required for DUI offenders in Iowa. These steps are often proposed instead of harsh punishments of incarceration or paying fines.
