« New Arizona DUI Law For Ignition Interlock Violators
The Arizona Legislature is working hard this year to make DUI Laws little hard and tough. In proposed series of articles this is the first one on which discussion is going on that how it will impact the prosecution and defense of the drunk driving in Arizona.

One thing is for sure that Arizona DUI law is already strict about the jail punishment time as compare to other states in Unites States. For example in some states don’t mandate the jail time on first DUI offense while in Arizona for first offense the offender must be sentenced up to 45 days in jail if his/her blood alcohol concentration is 0.20 percent or above.
Arizona Senate Bill 1069, in the latest legislation will be having several more things. Major part of bill is about future articles. For the purpose of this article, we take look that how the impact of law will be on DUI convicted people.
Lets take a look on its little background. Every DUI conviction in Arizona is having penalty of ignition interlock device, this device is a breath test machine attached to the ignition of a vehicle. The device is having a sensor for detecting breath alcohol. If device detects the presence of alcohol then it prevents vehicle from starting.
The people who oppose the ignition interlock gives the point that it is hard to police, and a lot of people drive without them. At present as it is a crime to drive without ignition interlock as ordered to DUI offender in Arizona, but this new law will make it more risky for violating the ignition interlock and driving without it.
This law will be more risky for ignition interlock violators because it will be lot easier that a person will be alleged for refusing to a chemical test than it is to convict him of DUI. In simple words it will open door for abuses. For example there is lot of cases in which it is not clear that a person refused to take a breath test. For that there can be some medical reasons that the person is not co-operating when they are, it can be the person is not physically capable of providing sample. But in case of ignition interlock it will not be same so it will be more risky for the people.
DUI defense lawyers in Arizona also agree that it will give lot of power to police, that just allege the person for refusing and he/she will be in jail for 4 months.
This will affect all those people who are having ignition interlock in their vehicles even for underage persons.
