« Texas DUI/DWI Penalties

There are two definitions for intoxication in the Texas Legislature. The first definition is that if a driver is intoxicated and had a below normal use of physical or mental faculties because of alcohol, drug, or controlled substance use. If any driver is having blood alcohol concentration (BAC) 0.08 percent or above, the driver will be considered intoxicated according to second definition.

Texas DUI Penalties

For first DWI/DUI offense driver will face fines up to $2,000, imprisonment from 72 hours to 180 days, and suspension of driving license for 90 days to 1 year. They must also have to take part in alcohol assessment/rehabilitation program. The judge will order between 24-100 hours community service. There is12 hours DWI Education Program which is compulsory for first time DWI offenders.

For second DUI/DWI offense there is fine up to $4,000 plus jail time ranges from 30 days to 1 year, and license suspension will last from 180 days to 2 years. There is 80-200 hours community service which offender must have to serve and also have to complete 32 hours of a DWI Repeat Offender Program.

There are more strict punishments for third DUI/DWI offense. For third offense driver can be fine up to $10,000, 2 to 10 years in jail, and a driver license suspension for 180 days to 2 years.

If any driver under the age of 21 years will be having blood alcohol concentration 0.02 percent or above will be subject to DUI/DWI penalties. He/she will face fine up to $500, 20-40 hours community service, and a 60 days license suspension. The convicted underage driver must have to the alcohol awareness classes also.
