4000 Wrongful Drunk Driving Convictions

Breath test in driving under influence (DUI) offense is considered as necessary for presumptive evidence. Now, reliability of breath test is making a big question in prosecution. Whenever, a DUI offender challenges the reliability of breath test, prosecutor faces the problems in order to prove the offense. Recently, there were many cases of DUI offense in Texas reported in which breath tests were fraudulently established.

It was observed that fraudulently operated machines for breath test caused the thousands of unfair convictions in DUI. The contractor is wrongfully manipulated the breath tests rather than changing the reference sample each month.

There are recently made many cases faced by Washington state police of fraudulent breath testing. The director of Washington State Patrol Forensic Laboratory Bureau has been resigned due to this recent breath test scandal.  This resignation of director comes due to the ruling out of this fraudulent breath tests by King Country judges. It was found in ruling that state toxicology lab falsely manipulated and wrongfully suspect the drunken drivers in DUI offense.

Rule to Operate Accurate Breath Test

Michigan has not experienced such misfortune; however, breath test program of Michigan is also definitely not protected from these problems.

Administrative rules for Michigan’s breath testing can be comparatively interpreted in this manner.

  1. According to rule 3 (1), any breath test instrument used for presumptive evidence shall be examined once in a week for its accuracy.
  2. The test is not required to perform within 7 days; however it shall be carried out in less than 14 days.
  3. Breath test shall be preceded accurately according to the predefined approved standard for its accuracy.
  4. Breath test shall be obtained using a controlled and calibrated device using a given alcohol vapor content 0f 0.080 grams per 210 liters.

Class II and IV Operators

Usually Class II operators of the different departments of police, jails and any other law enforcement organizations organize and precede the weekly calibration tests.  Police officers only have 6 hour day of practice by means of nearly 70 percent written test. There is no expertise testing system available to qualify the breath test of Michigan quality assurance program. Inspections of 120 days are usually operated by a Class IV operator. There is no way to charge an agency for mistake.

Recovery of charge

A criminal defense is always required for any uncovered fraudulent test. There are some ways to recover the false breath test charges. A cross examination of breath test is also a hope to challenge the fraudulent charge of drunk driving.
