Police had made plan across the country for DUI enforcement on most celebrated adult holiday of the year the Super Bowl Sunday. All states police are planning and announcing DUI checkpoints and putting extra police force on the road. Police officers will be looking for signs of impairment and they are given orders to pull over a vehicle for a minor traffic infraction. Violating signals, having expired driving tags on vehicle or reckless driving are all the major reasons that makes an officer to pull over a car this Sunday.

Ok, so it has been said by the cop that I looked bad on the field sobriety tests, but I know myself that I’m not guilty: I only had two drinks and I have got the witnesses. It doesn’t matter what the arresting police officer is saying, I can tell my side of the story to my fellow citizens and then let them decide. Right?

 

Trial by Jury

 

Well that is not necessary. This right to jury trial, had been handed down centuries ago from England’s Magna Carta, it was considered so fundamental to the framers of our Constitution that it had been included by them in the Bill of Rights? This is what we call Sixth Amendment. So it makes no exceptions to this sacred right to trial by a jury of peers.

 

So why is this happening that some states today are denying jury trial to a person who is accused of drunk driving? Why is that, for instance, an American citizen who has been arrested in New Jersey is forced to accept the decision of a politically-appointed judge? After all, on that subject the Sixth Amendment is pretty clear:

 

“In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed…”

Man charged with DUI 4 times legal limit »

Deputies had arrested a man that found passed out in his vehicle. He was having a blood-alcohol level of more than four times then legal limit.

It has been reported by The Marion County Sheriff’s Office that authorities have been called upon by a gas station clerk Monday night and he told them about a man passed out in a vehicle. It has been found by a deputy that the man, who was later identified as Rafael Delgado Rivera, smelled like alcohol, he had bloodshot eyes and slurred speech was used by him.

Common DUI Terms; What does all this mean? »

APS, or Administrative Per Se:
In California as with many other states, there are two separate cases that arise from a single drunk driving arrest: the court case, and the Administrative Per Se, or A.P.S. case, with the Department of Motor Vehicles. In cases where someone is arrested for DUI the DMV will take an “administrative action” against the driver. Note: The DMV only allows you Ten days to set a hearing: that is why it is so important to contact a lawyer right away.


Acetone:
an organic compound commonly found in the breath that can be improperly read as alcohol by the Intoxilyzer.
Absorption:
The taking of alcohol from outside the body into the bloodstream. Peak absorption refers to the highest level of blood alcohol seen before blood alcohol content (BAC) begins to diminish.
Arraignment:
The initial court proceeding, where someone arrested for DUI, or any related drinking and driving criminal charge is formally advised of the charges against them, and given an opportunity to enter a plea.
BAC:
Blood alcohol content.
BAL:
Breath alcohol level.
Burnoff:
The ability of the body to metabolize alcohol, and eliminate it from the system through the functioning of the vital organs. The rate of burnoff will vary from person to person, and even be different for the same person depending upon various factors. This is just one of the reasons that retrograde extrapolation is such a difficult task, and why the results are uncertain.
